1. Agreement to These Terms

These Terms of Service govern your access to and use of the website at blopezrealty.lol and the brokerage desk services described on it. The website is operated by Blopez Realty Inc., a company located at 176 W Lady Bank Way, Salt Lake City - 84115-5083, United States (US).

By visiting the website, sending a message to the desk, or requesting a showing run, you agree to these terms. If you do not agree, you should not use the website or ask the desk to perform a service for you. If you are using the website on behalf of an organization, you confirm that you have authority to bind that organization to these terms.

These terms apply to the website and to the administrative side of the desk. They do not replace a separate written agreement for brokerage representation, a listing agreement or a purchase contract. Where a separate written agreement conflicts with these terms, the separate agreement controls for the matter it covers.

2. Definitions

In these terms, the word company means Blopez Realty Inc. The words we and us refer to the company. The word website means the pages served at blopezrealty.lol, including the homepage, the services page, the contact page and the legal pages linked from them.

The word desk means the brokerage front desk operations described on the website, including key custody, listing board management, open house runs, offer tracking, sign and lockbox service and closing day checklists. The word client means a person or organization that has asked the desk to perform a service.

The word run means a scheduled open house showing window managed through a printed run card. The word record means any ledger line, listing sheet, run card, tracking sheet, checklist or similar document, whether on paper or in electronic form.

3. Eligibility

You must be at least eighteen years old to send a request to the desk or to enter into a service arrangement. If you are younger than eighteen, you may use the website only with the involvement of a parent or guardian who accepts these terms on your behalf.

You must be able to form a binding contract in your jurisdiction. If you are accessing the website from a place where its content is unlawful, you are responsible for complying with local law and should not use the website.

The desk may decline a request where it cannot verify the identity of the person making it, where the request appears to involve a property the person does not control, or where providing the service would conflict with a legal or safety obligation.

4. Permitted Use of the Website

You may view the pages of the website, print a copy for your own reference, and follow the links provided. You may use the contact form to prepare a message to the desk. These permissions are personal and non transferable.

You agree to use the website only for lawful purposes and only in a way that does not interfere with the operation of the site or the work of the desk. You may not attempt to gain access to any part of the site that is not intentionally public.

The desk may change, suspend or discontinue any part of the website at any time. We try to keep the content accurate, but we do not promise that every page will always be available or free of error.

5. Prohibited Conduct

The following conduct is not permitted. This list is illustrative and not exhaustive.

  • Submitting information that is false, misleading or intended to impersonate another person.
  • Requesting a showing run for a property that you do not own and are not authorized to represent.
  • Copying, scraping or republishing substantial portions of the website without written permission.
  • Introducing malicious code, attempting to probe the site for vulnerabilities, or interfering with its normal operation.
  • Using the website to send unsolicited advertising or bulk messages.
  • Using contact details published on the website for marketing that the desk has not authorized.
  • Removing, obscuring or altering a sign, lockbox or key record belonging to another party.

If the desk reasonably believes that a person has engaged in prohibited conduct, it may decline service, block access to the website and preserve relevant records for legal purposes.

6. Desk Services

The desk provides administrative support for residential brokerage operations. The six services are described on the services page and summarized here for convenience. Key Custody Desk maintains the key safe wall and the custody ledger. Listing Board Management keeps the pinned listing board current and consistent with the office record.

Open House Runs plan and document showing windows through printed run cards. Offer Tracking Sheets log offers on arrival with a timestamp and preserve the record through closing. Sign and Lockbox Service deploys, records and recovers signage and lockboxes. Closing Day Checklists collect keys, pull signs, close lockboxes and seal the listing record.

A service request becomes binding when the desk confirms it in writing, usually by email. The confirmation states what the desk will do, the property involved, the window of time and any condition that applies. Work requested outside a confirmed window is treated as a new request.

7. Key Custody Terms

When you hand a key set to the desk, the desk will assign a slot on the key safe wall and open a custody ledger line. You are responsible for telling the desk which doors the key set opens and whether any key on the set should not be duplicated. The desk will not copy a key unless that is separately agreed in writing.

Keys are released only to an agent named on the listing sheet or to a person the client has authorized in writing. The desk records the agent, the time out and the expected return window. If a key is not returned by the expected window, the desk will contact the agent and, if necessary, the client.

The desk counts the key safe wall twice each business day. If a count reveals a discrepancy, the desk will investigate before closing for the day and will inform the client of the outcome if the discrepancy concerns the client key set.

The client agrees to collect every key set when a listing closes or when the service ends. The desk may continue to hold an uncollected key set for a reasonable period while it attempts to arrange collection, and may charge a storage fee for keys held beyond ninety days, provided the client has been notified in writing.

8. Open House Runs

A run is planned on a printed card listing the address, arrival window, sign placement, lockbox identifier, feedback sheet and agent on duty. The desk prints cards the day before a run and expects each card to be signed when the showing window closes.

The client is responsible for confirming that the property is ready for showing, that access is available and that any required permission from a tenant or occupant has been obtained. The desk plans the run and documents it; the desk does not guarantee attendance by buyers.

The agent on duty must remain present for the whole window and must close the property at the end of the run. If a run must be cancelled, the client should notify the desk as soon as possible. Runs cancelled after signs are placed may incur a charge to cover the placement and recovery work.

9. Offer Tracking

The desk logs each offer that reaches it on a numbered tracking sheet with the arrival time, buyer side contact, offered amount, expiration time and stated conditions. The desk timestamps the sheet when it arrives and preserves the sheet through closing.

The desk does not evaluate, rank or recommend offers. Those decisions belong to the seller and any adviser the seller chooses. The role of the desk is to record and preserve, and the client agrees not to treat the timing or order of logged offers as advice about value.

The client is responsible for ensuring that offers are delivered to the desk through the channel named in the listing agreement. An offer that reaches an individual agent rather than the desk is logged as soon as the desk learns of it, but the desk cannot guarantee the timestamp of an offer it did not receive directly.

10. Signs and Lockboxes

Signs, riders and lockboxes remain the property of the desk unless a written agreement says otherwise. The desk assigns an identifier to each piece it deploys and records where the piece is placed. The client agrees not to move, remove or alter an item without telling the desk.

Lockbox codes are rotated after every open house weekend and whenever a listing changes hands between agents. Codes are delivered to the assigned agent directly. The client agrees not to publish a lockbox code or share it in a group message.

If an item is lost, damaged or stolen while deployed, the desk will investigate and will ask the client to cover the replacement cost unless the loss resulted from the negligence of the desk. The desk reports untraceable items to the office manager on the day they are discovered.

11. Closing Day

The closing checklist is run in a fixed order: collect keys, pull signs, close lockboxes, return crate items to stock, reconcile the key safe wall, write the final tally and file the listing sheet with the offer tracking records. A closing is complete in the desk record only when every line is initialed.

The client agrees to confirm in writing when a sale has completed, so that the desk can begin the checklist without delay. Delays in confirmation may leave signs standing longer than expected, and the desk is not responsible for the appearance of a sign during such a delay.

When the checklist is complete, the desk sends the client a short written confirmation naming the items collected and the date of collection. That confirmation is the record of the desk side of the closing.

12. Fees and Payment

Fees for desk services are stated in the written confirmation for each request or in a separate service agreement. Unless the confirmation says otherwise, fees are due within fifteen days of the date of the invoice.

Fees cover the administrative work described in the confirmation. Third party costs, such as replacement signage, are billed at cost with a written note explaining the charge. If a request changes materially after confirmation, the desk will explain any adjustment before the additional work begins.

Late payment may result in suspension of new work until the account is current. If a payment dispute arises, please tell the desk promptly so that the matter can be reviewed. The desk will not suspend work that is necessary to protect property or to return a key set without first explaining the situation to the client.

13. No Agency or Legal Advice

The desk provides administrative brokerage operations support. Nothing on the website or in desk correspondence creates a brokerage relationship, a fiduciary duty or an agency relationship beyond what a separate written agreement establishes. The desk does not provide legal, tax or investment advice.

Information about keys, signs, offers and closings is operational rather than legal in nature. The client should consult a qualified professional for questions about contract terms, disclosure duties, title matters or tax consequences.

The desk does not negotiate on behalf of a buyer or a seller and does not make promises about price, timing or the outcome of a transaction. Any such decision belongs to the parties involved.

14. Website Content and Ownership

The text, layout, styling, code and design of the website are owned by the company and are protected by copyright and other intellectual property laws. The name Blopez Realty Inc., the desk descriptions and the page designs are part of that content.

You may view and print pages for your own use. You may not copy the design for a competing website, reproduce substantial portions of the text, or use the company name in a way that suggests endorsement without written permission.

The website is provided as a general description of the desk and its services. Descriptions on the website are not a substitute for the written confirmation that governs a particular request.

15. User Submissions

When you send a message to the desk, you grant the desk permission to use the content of that message for the purpose of responding to you and performing any service you request. That permission is limited to those purposes and does not allow the desk to publish your message.

You confirm that any information you send about a property is accurate to the best of your knowledge and that you are authorized to share it with the desk. You agree not to send content that infringes the rights of another person.

The contact form on this website does not store data on a server. It prepares a message inside your browser and opens your own email program, and you decide whether to send it.

16. Third Party Services

The website may refer to services offered by other organizations, such as a title company, a lender or a professional association. Those organizations are independent of the desk, and the desk does not control their work, their fees or their privacy practices.

Where the desk coordinates with a third party on your behalf, it will say so in the written confirmation. Coordination does not make the desk responsible for a third party action or omission.

Links to third party pages are provided for convenience. The desk does not endorse every statement on those pages and may remove a link at any time.

17. Disclaimers

The website and its content are provided on an as available basis. To the extent permitted by law, the desk makes no warranty that the website will be uninterrupted, error free or free of harmful components, or that the content is complete or current.

The desk makes no warranty about the condition of a property, the accuracy of information supplied by a client or the outcome of a showing run. Showings depend on factors outside the control of the desk, including buyer interest and market conditions.

Nothing in these terms excludes a warranty that cannot be excluded under applicable law, including a warranty of fitness for a particular purpose where such a warranty is mandatory in your jurisdiction.

18. Limitation of Liability

To the extent permitted by law, the company will not be liable for indirect, incidental, special or consequential damages arising from your use of the website or the desk services. This includes lost profits, lost opportunities and loss of goodwill.

The total liability of the company for a claim arising from a desk service is limited to the fees paid for the specific service that gave rise to the claim, or to one hundred United States dollars where no fee was paid, whichever is greater.

These limits do not apply to liability for fraud, willful misconduct or any liability that cannot be limited under applicable law. If a court finds that a limit is unenforceable, the remaining limits continue to apply.

19. Indemnity

You agree to defend and indemnify the company against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the website, or content you send to the desk that infringes the rights of another person.

This obligation does not apply to the extent that a claim results from the negligence or misconduct of the company. The desk will give you notice of a claim that falls under this section and will allow you a reasonable opportunity to participate in the defense, subject to the rights of the company to protect its own interests.

If you are a client and the claim concerns a desk service, the desk may choose to handle the defense itself, in which case you will cooperate with reasonable requests for information.

20. Suspension and Termination

The desk may suspend or end access to the website or a desk service if a person breaches these terms, if a request appears fraudulent, or if continuing the service would create a legal or safety risk. Where practical, the desk will explain the reason in writing.

You may end a service at any time by notifying the desk in writing. Ending a service does not cancel fees already due, and it does not remove obligations that arose before the service ended, such as returning a key set.

On termination, the desk will follow its standard closing routine: collect keys and signs, close lockboxes, write the final tally and confirm the handover in writing. Records are retained as described in the Privacy Policy.

21. Disputes and Governing Law

These terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Before starting a formal proceeding, the parties agree to attempt to resolve a dispute through written discussion, giving the other side at least thirty days to respond.

If a dispute is not resolved through discussion, it may be brought in a court of competent jurisdiction serving Salt Lake City, Utah, and each party consents to that jurisdiction. The parties waive any objection to venue in those courts.

A party that wins a dispute may recover reasonable legal costs where the law allows. Nothing in this section prevents a party from seeking urgent relief to protect property or personal safety.

22. Changes to These Terms

The desk may update these terms from time to time. When a change is made, the date at the top of the page is revised. Material changes are announced by email to clients with an active correspondence record.

Continued use of the website after a change takes effect means that you accept the updated terms. If you do not accept a change, you may stop using the website and end any active service by notifying the desk in writing.

The desk keeps previous versions of these terms on file and can provide a copy on request. A written confirmation for a service states which version of the terms was in effect when the request was made.
